Welcome to ACTORQ.com (a subsidiary of "Q"towns) and “Q” Towns Daily Deals.
This is the Terms of Service Agreement (“the terms “) ACTORQ.com, (”The Web Site” or Actor “Q” Daily Deals")
The term “you” refers to the person accessing or using the Site or our Services, or the company or organization on whose behalf that person accesses the Site or our Services.
The Services include the opportunity for you to purchase specials Daily for the products and services of third party merchants. The Services and Site are together referred to here now as ACTOR “Q”.
Please review the following terms carefully. By using the Site or any ACTOR "Q Services, you are agreeing to these terms, as well as our Privacy Policy
“Q” is our Conception. Represents the Voucher or Coupon.
The Agreement incorporates the Privacy Policy and details on site such as the FAQ, which taken together, describe the rules that must be obeyed by any person, who establishes a connection for access to and use of the Site (“User”).
TERMS OF ACCEPTING
By using or visiting the Site, you expressly agree to be bound by the Terms and to follow these Terms and all applicable laws and regulations governing the Site.
CHANGES TO TERMS AND SERVICES
The Company has the right to modify or discontinue any feature or aspect of the Site at any time. The Company also has the right to change the Terms governing any User’s use of this Site at any time. The change in the Terms will be effective immediately upon posting the changes to this Terms page or elsewhere on the Site. Any use subsequent to these changes shall be deemed to constitute acceptance by the User of such modifications, additions, or deletions.
USER INFORMATION
In order to use certain Services on the Site, you may be required to provide personal information (such as identification or contact information), as part of the registration process, or as part of your continued use of the Services. You agree that any registration information you give to The Company will be accurate, correct and up to date.
PARTICIPATION
To participate, ACTOR “Q” Daily Deals requests The User’s permission to send both administrative and promotional e-mails. Upon registration, The User consents to receiving these and other forms of electronic correspondence about account activity and purchases, as well as Site updates and promotional offers. The User may opt-out at anytime by clicking the unsubscribe link at the bottom of any electronic correspondence.
USE OF THE SITE AND SERVICES
Using ACTOR “Q” is conditioned upon your agreement that you:
You are 18 years of age or older to purchase any Daily Deal;
You will comply with these Terms of Service.
You will not use any parts of the site- including writing, pictures, logos, reviews etc.
You will provide accurate information and create only ONE account.
You are solely responsible for your submissions, including discussion posts, profile information and links, pictures, and other such content where available on Site and future widgets etc.
You will not submit Content that is copyrighted or subject to third party proprietary rights, including privacy, publicity, trade secret, etc., unless you are the owner of such rights or have the appropriate permission from their rightful owner
ACTOR “Q” affirms we have the right to determine whether any of your Content submissions are appropriate and comply with these Terms of Service, remove any and/or all of your submissions, and terminate your account with or without prior notice due to multiple accounts etc.
OUR DAILY DEAL OFFERINGS
ACTOR “Q” takes no responsibility for the services or products for which a “Q” may be redeemed – ACTOR “Q” makes no warranty to the End Users for the quality, safety, usability, or other aspect of the product or service for which the Voucher is redeemed. Some services for which a “Q” can be redeemed are activities that involve potential bodily harm (such as skydiving, etc), and for those activities, ACTOR "Q"takes no responsibility for the service or activity being offered, and the End User takes responsibility for his or her own actions in utilizing the services for which the “Q” can be redeemed
By making a purchase, you agree to abide by the restrictions included in the offer details stated by the merchant for the “Q”.
The “Q” you purchase is redeemable for goods or services by the seller of such goods and services, hereinafter defined as “Merchant.”
The Merchant, not ACTOR “Q”, is the seller of the goods and services. ACTOR “Q” sells a “Q” or voucher that can be redeemed in connection with your purchase of the goods or services from Merchant.
Your purchase is subject, but not limited, to the following conditions. Additional conditions outlined by the Merchant apply to the Voucher.
Vouchers are offered at below face-value. As a result, they are redeemable only for one visit not incrementally unless otherwise noted.
Limit of one (1) Voucher per customer unless explicitly stated otherwise by the Merchant.
If you redeem the Voucher for less than its face value, you will not be entitled to a credit, cash or new Voucher equal to the difference between the face value and the amount you redeemed, unless otherwise required by law.
The End User, You- are responsible for paying sales tax, tip, or shipping and handling if applicable.
The Merchant is responsible for following state tax, gift certificate, and consumer laws.
The Merchant has the discretion to require advanced reservation, appointment, or to limit redemption over a period time based on the Merchants capacity.
Redemption of the Voucher for alcohol if applicable and at the discretion of the Merchant and is subject to state laws governing the Merchant.
Unless clearly stated, the Voucher is not able to be combined with other offers, discounts, or specials offered by the Merchant.
The Voucher if not fully redeemed is not good for cash. A credit for unused Voucher value is at the discretion of the Merchant.
Reproduction, re-sales, gifts, or trade of the voucher is prohibited unless allowed by state law, and voids your “Q” to the extent prohibited by law.
The “Q” expires on the date specified on the Voucher, except that the Merchant may continue to redeem the unused cash value you paid for the Voucher to the extent required by applicable law.
ACTOR “Q”, the seller, nor the Merchant is responsible for stolen or lost Vouchers.
LICENSE GRANTS
By posting communications on or through this Site, Users and Merchants shall be deemed to have granted to the Company a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication alone, Created Deal Advertising or as part of other works in any form, media, or technology whether now known or hereafter developed, and to sublicense such rights through multiple tiers of sublicenses.
USER PASSWORDS AND ACCOUNT
You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with your Account. You agree that you will be solely responsible for all activities that occur under your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify the Company immediately to Contact us at ActorQ.com
OFFER PURCHASE AND REDEMPTION
Redemption of merchant offers and/or certificate is subject to the limitations and rules set by the respective merchants, and such merchant certificates may not be available for use and redemption by individuals located outside the United States.
OUR ELECTRONIC COMMUNICATIONS WITH YOU
The Company will generally communicate with its Users by electronic means, such as e-mail. As a User, you give consent that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Privacy is taken extremely seriously at ACTOR “Q” Daily Deals.

LAWFUL USEAGE
User and Merchants shall not use this site for any unlawful purpose. Strictly prohibited actions include transmitting material: (i) that is unlawful, obscene, vulgar, defamatory, abusive, threatening, profane, invasive of privacy or publicity rights, or otherwise objectionable, (ii) that violates or infringes upon the rights of others in any way, (iii) that encourages others to commit unlawful acts, (iv) that contains advertising, publicity, or solicitation for a product or services that did not receive prior approval from the Company, (v) that inhibits other users from using or enjoying the Site.
COPYRIGHTS
All Contents and software on the Site is the property of the Company, affiliated companies, partners, or content suppliers. This includes, but is not limited to, all text, images, graphics, logos, designs and software code. You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have receive specific permission to do so in a separate agreement from the Company or by the owners of the Content. Unauthorized use of any content displayed by the Company is a violation of United States and international copyright laws. Company has the rights to represent Merchant deals, graphics and wordage on Company sites during and after deal Closures.
DISCLAIMERS AND LIMITATIONS OF RESPONSIBILTY
The Company makes no representations or warranties of any kind, expressed or implied, as to the operation of the Site or to the content, information, products, or services featured on the Site. We provide this Site on an “as is” and “as available” basis.
User agrees to use this Site at User’s own risk. User expressly understands and agrees that the Company, its employees, officers, shareholders, contractors, agents, affiliated parties, or any person or entity involved in creating, producing, posting or distributing the Company content will under no circumstances be liable for damages, including, without limitation, direct, indirect, incidental, punitive, or consequential damages arising out of the use or inability to use the Site, however caused and under any theory of liability.
To the full extent permissible by applicable law, the Company disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The Company does not warrant that this site, servers, or emails sent from the Site are free of harmful components, such as viruses.
Under no circumstance shall ACTOR “Q”, its merchants, advertisers, vendors, product or service providers be liable for any direct, indirect, punitive, incidental, special or non consequential damages that result from or arise out of the use or the inability to use this Site, information contained or received from this site
This limitation stands whether the possible liability is based on contract, negligence, strict liability or any other basis..
IDEMNIFICATION
You agree to defend indemnify, and hold harmless the Company, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
DISPUTES
If there is any dispute about or involving the Site, by using the Site, User agrees that the dispute will be governed by the laws of the state California without regard to its conflict of law provisions. User agrees to personal jurisdiction by and venue in the state and federal courts of California.
USER ID
ACTOR “Q” relies on User IDs to know whether users accessing the Site and using our Services are authorized to do so. If someone accesses our Site or Services using a User ID that was issued to you, we will rely on that User ID and will assume that access has been made by you. You are solely responsible for any and all access to the Site- including purchases made.
DAILY DEALS
ACTOR “Q” provides consumers with opportunities to purchase products and services from third party merchants (“Merchants”) with a time limited promotional added value (a “Deal”). Merchants offer promotional in order market their Business via the ACTOR “Q” community.
How It Works
By placing an order for a given Daily Deal, you make an offer to purchase the Daily Deal or “Q” you have selected on the terms, restrictions and conditions associated with the Daily Deal . Once you’ve placed your order, you will received a confirmation of the Daily Deal and your credit card will be charged for the amount of the Daily Deal. We will notify you by email when the “Q” (defined below) for the Daily Deal is ready to be used. You are required to create an account in order to purchase any Daily Deal. An account is for payments access to print your "Q.
The Voucher
Each Daily Deal combines two separate portions that make up the Deal: the paid portion equal to the amount your credit card is and a promotional portion for the value of the Deal if used by the promotional expiration date on the “Q”
Expiration Dates
The expiration date for a “Q” is as printed on the “Q”.
If the expiration of the paid value of the “Q” as of the date printed on the “Q” is prohibited under the law of the jurisdiction in which the Merchant is located, then the “Q” shall expire as follows: the promotional portion of the “Q” will expire on the date printed on the “Q”, and the paid portion of the “Q” will expire five (5) years from the date the “Q” is issued, except to the extent applicable law requires that the Merchant extend the period in which the “Q” may be redeemed. The Merchant is obligated to honor the “Q” in compliance with law. If the Merchant refuses to honor the “Q” before the legally permitted expiration date, then ACTOR “Q” may refund the paid portion of your Voucher in the form of a credit for future Daily Deals. In order to receive the credit, you must provide the following information in writing to ACTOR “Q”: -identification of the Voucher and Merchant with whom you sought to redeem the “Q”, – statement of the date, time, and circumstances in which the Merchant refused to redeem the “Q”, also a statement, under penalty of law, that the “Q” has never been redeemed with the Merchant.
MERCHANT RESPONSIBILTY
ACTOR “Q” is marketing daily deals and acts an as agent in selling the "Q"’s on behalf of the Merchants. Merchant is the issuer of the “Q”. As issuer the Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Merchant or its products and services, as well as for any unclaimed property liability arising from unredeemed or partially redeemed “Q”.
REFUNDS
ACTOR “Q” will provide a refund of the purchase price paid by you for any ACTOR “Q” Daily Deal for 3 days after the purchase of a Daily Deal "Q, as long as it has not been used. After 3 days, we do not provide refunds.
